Terms of Service
These Terms of Service ("Terms") govern your use of efarockies.org (the "Site"), operated by the Energy Freedom Alliance of the Rockies ("EFAR," "we," "us," or "our"), a Colorado social welfare organization operating under Section 501(c)(4) of the Internal Revenue Code.
By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.
1. Who we are, and what this Site is
EFAR is an advocacy organization. The Site contains political and policy advocacy, opinion, and commentary concerning Colorado energy policy. Content on the Site is provided for informational and advocacy purposes and is not legal, financial, tax, engineering, or professional advice.
EFAR is not authorized by any candidate or candidate committee.
2. Eligibility
You must be at least 18 years old to submit information, subscribe to communications, or make a contribution through the Site.
3. Permitted use
You may view, download, and print Site content for your personal, non-commercial use in connection with EFAR's advocacy. Any other use requires our prior written permission.
4. Prohibited conduct
You agree not to:
- Use the Site for any unlawful purpose or in violation of these Terms
- Submit false, misleading, or fraudulent information, including a contribution made in another person's name
- Attempt to gain unauthorized access to the Site, its servers, or related systems
- Interfere with, disrupt, or place undue load on the Site
- Scrape, harvest, or collect information about other users
- Transmit malware or any harmful code
- Impersonate EFAR or any person or entity
- Use the Site to harass, threaten, or defame any person
5. Intellectual property
The Site and its content — including text, graphics, logos, the EFAR name and marks, photographs, and design — are owned by EFAR or its licensors and are protected by intellectual property law. Nothing in these Terms grants you any right in our marks.
6. Content you submit
If you send us a story, comment, photograph, testimonial, or other content, you grant EFAR a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, adapt, publish, and display that content in our advocacy and communications, in any medium. You represent that you have the right to grant this license and that the content does not infringe the rights of others or violate any law.
We are not obligated to use, and may remove at any time, any content you submit.
7. Contributions
If you make a contribution through the Site, the following apply:
- Contributions to EFAR are not tax-deductible as charitable contributions for federal income tax purposes.
- Contributions are used to further EFAR's social welfare purposes, including political and policy advocacy.
- You certify that the contribution is made from your own funds, on your own behalf, and not from the funds of another person or entity, and that it is not made from funds prohibited by law.
- Contributions are generally non-refundable. If you believe a contribution was made in error, contact us at info@efarockies.org and we will review the request.
- We may be required to collect and report contributor information — including name, address, employer, and occupation — under applicable law, and to decline or refund contributions that do not comply with law.
- We reserve the right to refuse or return any contribution at our discretion.

8. Email and text communications
By providing your email address, you consent to receive email from EFAR. You may unsubscribe at any time using the link in any message.
By providing your mobile number and checking the consent box, you consent to receive recurring automated political text messages from EFAR. Consent is not a condition of donation or volunteering. 9. Third-party links and services
The Site may link to or rely on third-party websites and services. We do not control and are not responsible for their content, policies, or practices. Your use of them is governed by their terms.
10. Disclaimer of warranties
The Site and all content are provided "as is" and "as available," without warranty of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. EFAR does not warrant that the Site will be uninterrupted, secure, or error-free, or that content is accurate, complete, or current.
11. Limitation of liability
To the fullest extent permitted by law, EFAR and its officers, directors, employees, contractors, volunteers, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, use, goodwill, or profits, arising out of or relating to your use of the Site, whether based in contract, tort, strict liability, or otherwise, even if advised of the possibility of such damages. To the fullest extent permitted by law, EFAR's total aggregate liability arising out of or relating to the Site shall not exceed one hundred dollars ($100).
12. Indemnification
You agree to indemnify, defend, and hold harmless EFAR and its officers, directors, employees, contractors, volunteers, and agents from any claim, demand, loss, liability, or expense — including reasonable attorneys' fees — arising out of your use of the Site, your content, or your violation of these Terms or any law or third-party right.
13. Termination
We may suspend or terminate your access to the Site at any time, for any reason, without notice.
14. Governing law and venue
These Terms are governed by the laws of the State of Colorado, without regard to its conflict of laws rules. Any dispute arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in [ COUNTY ] County, Colorado, and you consent to their jurisdiction.
15. Severability and entire agreement
If any provision of these Terms is held unenforceable, the remaining provisions remain in effect. These Terms, together with our Privacy Policy and SMS Terms, constitute the entire agreement between you and EFAR regarding the Site.
16. Changes
We may revise these Terms at any time by posting an updated version. Changes take effect when posted. Your continued use of the Site constitutes acceptance.
